Terms of Use for SmartProperty

By utilizing SmartProperty, you accept the current terms of use. How SmartProperty works:

SmartProperty is a complimentary service that connects users with selected real estate agents and realtors tailored to their needs. By completing the form on SmartProperty, you inform realtors of your requirements. You will then receive offers from up to three to five agencies. Shortly after submitting the form, up to three agents or firms will contact you via phone, email, or SMS. From there, direct contact between you and the agent/firm continues. Should you wish your inquiry to be removed or deleted from the service, please contact help@smartpropertyspain.com

Using SmartProperty

Impersonating or claiming affiliation with SmartProperty or our partners to the public or specific recipients without basis is not permitted. All providers collaborating with us have signed written agreements. Accessing or attempting to access non-public parts of SmartProperty, or obtaining other users’ information, such as through hacking, is prohibited. Using or attempting to use SmartProperty for the dissemination of viruses, “trojan horses,” or other harmful code intended to obtain and/or copy other users’ information or other non-public information is not allowed. Negatively affecting other users’ ability to use SmartProperty is prohibited. Pretending to be another physical person or wrongfully acting on behalf of other physical or legal persons is not allowed. In the case of actions that contradict good practice, such as false or misleading inquiries, SmartProperty may block the service for the user in question.

Responsibility and Relationship with Providers

SmartProperty only facilitates contact between users and providers. Thus, SmartProperty is not involved in the creation of the offers or the services they pertain to. The specific agents and firms are independent of SmartProperty, and we cannot guarantee that the relevant providers will actually contact the customer with offers. Using SmartProperty is at your own risk. Agreements made between the customer and provider, and their content, are irrelevant to SmartProperty. SmartProperty is not responsible for the execution, quality, or legality of the agreement or its suitability for the intended purpose. SmartProperty is also not responsible for compliance with agreed delivery times or any losses users may suffer as a result of the agreement with the provider or errors made by them. However, SmartProperty strives to collaborate only with serious and reliable actors. Providers that do not fulfill agreements or meet SmartProperty’s quality and reliability requirements are excluded. SmartProperty collaborates with selected, independent agents and firms. Therefore, we cannot guarantee that the offers are the best or cheapest on the market. SmartProperty is not liable for non-fulfillment of its obligations if the deficiency can be attributed to force majeure. Conditions beyond SmartProperty’s control, which could not have been foreseen at the time of the agreement, are considered force majeure. The disclaimer persists as long as the unforeseen events last. Examples of force majeure include natural disasters or unusual natural conditions, terrorism, fire, flood, vandalism, labor disputes, general commodity scarcity, currency or import restrictions, or outbreaks of a contagious disease to such an extent that it affects SmartProperty’s ability to fulfill its obligations. This also applies to defects or delays from possible subcontractors or other third parties. SmartProperty is not responsible on behalf of the user or the provider for the tax and duty conditions that may arise from the use of SmartProperty. This includes tax, VAT, and/or other charges in connection with the provider’s services and the customer’s payment.

Intellectual Property Rights

All intellectual property rights relate to SmartProperty and the service’s owner, MarketLeaders Group. This includes – but is not limited to – the names “SmartProperty” and “MarketLeaders”,  trademarks in the form of figurative and word marks, copyright to material on the website, etc. These belong to MarketLeaders Group. The use of SmartProperty does not entitle users or third parties to any commercial use of these intellectual property rights. The use of SmartProperty also does not grant a license to use third parties’ (including providers’) intellectual property rights, including – but not limited to – copyright, trademarks, and design rights. SmartProperty is not responsible for unauthorized use of these.

Communication

All communication with SmartProperty occurs electronically. By using SmartProperty, users are not subscribed to newsletters.

Changes

We reserve the right to make changes to the terms of use on SmartProperty at any time and without notice. Continued use of SmartProperty after such changes is considered consent to the amended terms. The last update date of the terms of use appears at the top of this page.

Applicable Law and Disputes

The use of SmartProperty and any dispute arising from this is subject to Norwegian law. Disputes arising from the use of SmartProperty should be resolved amicably. If this is not possible, the dispute can be brought before the courts. Oslo District
